I think Jack has another cause of action now that they have actually taken possession of the house.

 

Before today, it was attempted fraud.  Beginning today is another cause of action and lots of damages.

The property line is defined as the curb, What the hell?

Like I said that COP or COPS were PAID, and I do hope the get HELL time for their willingness in these actions.

 

EMC had a choice to leave his belongings on the curb, they choose not too? OUT FOR BLOOD ARE YA EMC? 

That's alright, now EMC can be pursued for financially for EACH AND EVERY SINGLE ITEM STOLEN.

 

I'd call the police and file a police report, that your home has been robbed, and you know who the thieves were, and the conspirators. Have a list ready to hand over to the police, 24 Shirts, 17 dress pants, 1 tuxedo, 5 watches, WHATEVER! ANYTHING AND EVERYTHING in your home. List the pictures and mementos as absolutely PRICELESS.

 

Call the police, file the report turn the list of STOLEN items over to them and notify them that you ABSOLUTELY WANT THIS MATTER PURSUED. THIS NOW FALLS UNDER A D. A. CRIMINAL ISSUE. THEY VIOLATED THE LAW WHEN THEY DID NOT ALLOW YOU TO COLLECT THINGS FROM YOUR HOME, AND THUS YOUR THINGS HAVE BEEN "STOLEN!"

 

You will also want the news-press there, and the Local TV stations while you are filing your Police Report. This media coverage will make sure something is done. Also inform the police that the (sherriff's/constables/cops) would not allow you to get any belongings at all. THEY BROKE THE LAW, and THEY SHOULD HAVE TO ANSWER TO THAT!

 

My tears have dried and now I'm burning with furry.

 

Yet another phrase in the document. "STATE LAW requires all personal property be removed from the curb within 24 hours or risk personal property being removed as debris." EMC had a choice and they FAILED to make the right one, yet  again, and again, and again!

NEWARK- A New York moving company and its owners have agreed to pay $20,000 in civil penalties, costs and attorney fees for operating in New Jersey without a license, Attorney General John J . Farmer, Jr. and Division of Consumer Affairs Director Mark S. Herr announced today.

Galil Moving & Storage Inc., (a/k/a Greenway Moving Inc. and Greenway Storage Inc.), and officers Avi Shriki and Lisa Levine have agreed to cease and desist doing business in New Jersey until they are licensed and will pay affected consumers restitution, as well as the penalties to the state.

"The Division of Consumer Affairs' Office of Consumer Protection pursues movers that violate the law," Farmer said. "Whether you're a licensed or unlicensed mover, if you violate our consumer protection laws, we will prosecute you."

I don't even have words...it's a very sad day and my heart goes out to Jack -along with my prayers and whatever donation I can pull together will be mailed to Jack today. I just want to say -as sad and horrific it is -that this day was actually allowed to happen, I have to believe that it happened for a reason-and Jack's pain and monsterous loss was not in vain.

 

Jack's case and all the pain he has suffered -has to be part of a bigger picture ...one that we along with Jack will all see with clarity one day.

 

My belief is that Jack's real life nightmare will one day be used as a model to illuminate, stop and punish the people (all involved, from the government down) who had a hand in this atrocity! I pray that Jack (and all of us) can soon look back on this day and realize Jack's many efforts, sacrifices and pain sparked the necessary change Jack's case can accomplish. Further, Jack will find justice and true rewards -more than he could have imagined. God works in strange ways!

There is a bigger picture here ...even though all our hearts are broken -stunned, just stunned to see this day actually arrived-I must believe that Jack will be compensated financially and pridefully -knowing his pain wasn't for nothing! Please hang in there Jack -you are in all of our thoughts, prayers (and actions)...we will continue making noise and shining bright lights on this illegal foreclosure and how it was allowed to happen!

We feel for you Jack and everyone else who has lost a home.  We lost ours nearly 2 years ago, it still hurts.  Channel 4 sent a video crew to tape our eviction, it hasn't been used yet.   We had a mortgage for $65,00.00.  After they stole our house, they put on a second floor and sold it for $137,000.00.  This is what we  are up against.  I don't know how anyone can beat the greed for that kind of profit.

By the way the moving/storage company was there yesterday, Wednesday to make sure anything remaining was taken  

 

Imagine them emptying the refrigerator and having them a great meal at Jack's expense. This is more than a tragedy this is a DISGRACE!

 

Also I have tried to find the ordinance or statute that requires business that do eviction cleanups just as Reo Allegiance, etc. and still nothing.

All we need to know is if they have a business license to operate in Texas.

Did they both GALIL MOVING & STORAGE, and REO ALLEGIANCE Inc, have valid Business Licenses to operate in TEXAS at the time of Jacks illegal Foreclosure?

 

Can you call the city hall, or Better Business Bureau to find out WHERE you can call to get a business license?

 

Once you get a number to the correct office you can then Request information on those two companies, and they should be able to tell you.

I don't know Jack's case  but it would seem that the foreclosure was completed. There would be an eviction if Jack still owned the property. If the foreclosure had been completed than the new owner has every right to clean up the property and have it secured.

I am in Florida so it may be different. Business licenses are issued here at all levels of government from municipal to state depending on the type of license. Movers may be regulated by the state. All lot of counties have searchable online sites as well as at the state level. A lot don't.

This may be a moot point but why go after the movers? I know they are scumbags but after all they were hired by scumbags. It may be that they don't have a valid business license and that may be another hook to hang them by.

I am truly upset and offended by what has happened to Jack. It could happen to me;  and I am doing all I can think of to help.

Doesn't matter you don't know what you are talking about Jacks home is stolen.
People who buy these stolen homes are guilty of buying stolen property as are the real estate agents who sell the stolen homes. You don't seem to get what going on here subhuman slime like EMC, Litton, Fairbanks, Ameriquest etc. steal peoples homes on purpose for profit some of these people actually die from the stress. You should be spreading the word and helping us wouldn't it be cool to watch an EMC or Ameriquest employee get thown in a jail and get abused or fry in an electric chair for what they are doing to people like Jack and the rest of us.

You have a responsibility as an American citizen to bring these scumbags to justice.

Let me clarify there was no court ordered foreclosure of Jack's home. Instead and if you had read the postings from Jack about his case (letter to

Dept of Commerce) you'd understand that Jack was forced to accept a mediation settlement. The settlement damned Jack either way.

 

I think you made a type error when you stated, "There would be an eviction if Jack still owned the property.". I think you may have wanted to say that if Jack does not own his the property. Big Difference!

 

Please refrain from making assumptions.

 

This is for another poster regarding the Moving/storage people it is possible as I posted that this firm may be in violation of a Texas licensing ordinance.

 

This is an issue but not as important as the illegal eviction, or the exhausting settlement mediation Jack had to endure for hours and hours. It all ties in to the fraud perpertrated against Jack by EMC and the court system.

 

There are jurisdiction questions and Due Process of Law here. Maybe there is a need for a Venue change?

 

Most importantly we need to focus all our strengths, actions, research, etc. in support of Jack who has unfailing served us victims these past 10 years.

Jack needs us to be positive and to act not react.

Jack is a true American hero putting his own interests aside to serve the greater good.
Even in the middle of an extreme crises where he is being thrown out of a home he lawfully owns he's still fighting to help all of us. We all need to support Jack using the facts which are on his side instead of making up non-sense like "the new owner has every right to clean up the property and have it secured" Doesn't matter, Who is the new owner?
Where do you get your information from, and what's your interest in Jacks case?

I just have a couple of minutes to respond. (Been a tad busy.)

 

This latest thing that happened has pulled a lot of positive energy and attention towards our issues.  It has caused such an outrage, that some who had had no idea this has been going on and who would normally not be involved, now DEMAND to be included.

 

All of us needed this to happen and it is being documented in detail and will be available to you regardless of your fraudster.

 

Three weeks ago, I told EMC's counsel, Fulbright & Jaworski, that once EMC took possession of my home, they would be setting themselves up for substantial liability, but did not mention the details.  I have since learned that I had underestimated their liability and it seems to be reaching farther than I imagined. 

 

I, or someone, will be putting information here and elsewhere on this site and others that I want you to use.  Please take advantage of it because it is all admissible to evidence the extent of what lengths these servicers will go to.

 

They say when one door closes, one opens up. Well, I am being shown that we are having a hallway of doors opening for all of us.  The attention we have been lacking is now coming and I am excited for all of us.

 

I am doing just fine and can't tell you how much I appreciate your concern and admire your fighting attitude.

 

Without giving the details of what is going on to finally explode this issue, please understand we needed this to happen and I am more than happy that it did.  Numerous people are working on this.

 

Take care and have the best holiday you can and I will post when I can.

Jack,

 

It's people like youself who give the rest of us the strength, hope and perspective that we quite often need in such dire situations. When we continually fight the fight, but appear to gain nothing, except dispare and frustration, and further humiliation we quite often need someone to remind us that there are still some truly good and honest people among us. People who are ready, willing and able to put the good of group ahead of their own desire and needs. Thank-You Jack, and Thank-You to all the other fine people here at this forum who I greatly respect, those who also give so much of their own time and energy to help others in there time of need. If nothing else... it certainly proves that there are still good people out there, and that the majority are not mindless, soulless scumbags, the unfortunate ones who are merely slaves to greed and their own selfish wants and disires. We should be very joyful in knowing that unlike the MS Fraudsters, we are not mindless, unfeeling trolls who are willing to do anything in the name of greed. I pray their rein will soon be at and end and hopefully America will have the strength to recover and once again become the great democracy it was once known to be.
