A deed in lieu (full name "Deed in Lieu of Foreclosure") We can provide that only if it has been requested to accept the Deed in Lieu of Foreclosing on your property.  If this is something that you have not applied for this document won't exist. Under usual circumstances a loan is only allowed 1 Modification for the entire life of the loan.  During these economic times Saxon is looking into redoing mods for people that might have already had one. It depends on you situation, to find out if you qualify just call.

 I dont use Saxon but I think this is unjust.  Please watch this maybe it will give some of you hope.  Contact your local Gov Rep too.

   just a update. after getting saxons request for summary judgement dismissed in the 6th dist[ florida] on jan 15 09 got a new court date for june 6th 09 except from a different co. claiming to hold note. nobody can find note but my case goes way beyond a lost note defense what they presented in court was a xerox copy with my daughters name on it [ mising on my origional] as a borrower only thing when judge looked at the part of the mortgage that was signed by the borrowers her name was missing and only my signatue was there, how do you spell fraud. also the origional mortgage co by law has to disclose what % of loans are sold 2004 0%  2005 0%  2006 0%. also these new claimits have no absolutly no documents to back anything up or anything to show they had bought taken possesion or were given the servicing rights to my note. on march i requested a production of docs from saxon filed and stamped by the clerk of the 6th dist court, with no answer in 45 days i next filed a motion to compel again fild with the clerk again no answer on april 15 th i sent a qualified written request. none of these requests were answered. i have not checked but i am positive that a sale or assignment of my note has not been filed with the pinellas co. fl. clerk as required. the only fileing will be by my origional note holder. fl judges know what is going on these affadavits of lost or missing paperwork are bullshit. how can anyone loose a paper worth hundreds of thousands of dollars. no wonder the financial sector is in the tank. they want a judge to believe that w/o any evidence, not a scrap of paper that they have a right to take your house away from you. lucky fl. is what is called a judicial forclosure state they have to give you a day in court. there are many nonjudicial states where they dont have to even tell you are being forclosed on in court they just show up and take your home away, trust me that law was bought and paid for by finincial institutions. hope this helps somebody   steve in st petersburg

We all know, Saxon Employee, that we never talk to any of you on the phone. You lie, you cheat and you steal our homes. Most of us were victimized on the PHONE by scavengers such as yourself. We know that the phone is a way for you to create the perfect lie. We trust nothing you tell us over the phone. The phrase JUST CALL US is what led us into losing our house. Saxon is no different than the others. I understand you need a job too, but just make sure that your conciense is in check. When I was lied to by some one at HomEq I woundered how she slept at night. She purposely lied to me and she did it on purpose. It's all part of the training. We all have to answer to a higher power. If a job is worth lying to someone and stealing from someone then they will have to answer for their actions one day. We may all remember that we are not suppossed to steal. Do you think there are acceptions to this rule? I think not.

Saxon took over my loan in 2007. Initially  had some problems with them, and through my attorney worked them out.
This year in Feb. and June Saxon sent a photographer to my house. He would tell me nothing except that he was sent by Saxon. Last week I received a foreclosure notice claiming they hadn/t received a payment since Feb. I had been making payments every month. I have five of six receipts. I am meeting with my attornry tomorrow. I hope I can avoid foreclosure. Paying for your home should not be so difficult.

I purchased my home in 2005 with NovaStar. In 2007 Saxon took over. That is when my problems began. Like everyone else they (Saxon) saying that I had not made any payments in months. In August of 2008, I received another letter saying that I had not made a payment since March and  my house was going to be foreclosed on. In March of 2009 I received a letter from their lawyer stating that my home was going up for sale in April. In May I received a letter saying that I could modify my loan. I had already been turned down twice for modification. I had already began moving my things out. I was told by someone on the phone that you do not move out until you get a letter (eviction letter). I don't know if this is true. But then the same person also told me that I had better start getting my things out, because my house goes up for foreclosure in June. I have not heard from anyone, but will be moving out in August.

To avoid any misunderstanding, please be advised that Craig Hosay's office in Pennsylvania has not yet filed a class action suit, as indicated in a previous post.  The office is still reviewing data to assess the viability of any legal action, but has not filed suit at this time.

I know that Saxon is part of the Morgan Stanley machine, but does anyone know if Duestche Bank is funding loans to originators that in turn sell the loans to Morgan Stanley mortgage trusts serviced by Saxon?   If that's the case Duestche bank is raking in the $$$$$$$

All my issues with Saxon Mortgage started when Hurricane IKE hit here in the Houston, Texas are in Sept. 2008.
During the first part of the year in 2008 I was behind with my mortgage payment as my work was really slow, being self employed.  So the first thought was to call Saxon Mortgage and tell them what has been going on and to see if they could help me, in return they put me on a re-payment program with them.

 I agreed to pay it and be on time with their agreed amount that I was to pay. Now being the only income provider as I'm a single person, my payment was set at $2000.00 per month. I agreed to pay that amount and I was doing OK until Hurricane hit here in Houston, Texas. During the time that the Hurricane hit,  I was due to make another payment to them, this was to be the second to the last payment that I owed to them. As I already paid all the way till then. Well we had lost all power, all forms of communication, no food, no gas, no phones, cell phones, water, everything was out. My state Governor Rick Perry had declared a State of emergency, and told the people of Houston that your creditors would work with you thru this tough time that Hurricane IKE had caused here in Houston, Texas.

When I was finally able to call Saxon to pay my payment, after we got power and was able to call out with phones,  I told them that I would like to pay the re-payment agreement in full and be over with it so that I could resume my original payment which was $ 924.01 per month.  They refused to take my payment and told me that the re-payment program was canceled out during the time that the Hurricane had hit here in Houston, Texas. I told them what had happened and its like they thought I was trying to make up some kind of excuse. I begged them to take the payments and they told me that there was nothing they could do, Except for them and myself to do another re-payment program with them and now the re-payment program would be a fee of $ 2800.00 per month for another 9 months. I told them that I couldn't afford it as I'M a single income person in my house. I even told them that it was very hard for me to pay my original re-payment program of $2000.00 per month. It just seemed as they didn't care about anything that had hap pend here in Houston and all the devastation the Hurricane IKE had caused.

I called them several times after the first call I was able to call them after the Hurricane. Again their answer was there's nothing you can or we can do. Just a another re-payment program. I had even told them about that we were in a state of emergency here in Houston, and it was like no big deal to them. 

week after week I have been calling them to make some kind of arrangement with them so that I don't loose my house as I have owned my home for the last 11 years.

Finally they called me and said they could do a loan modification program and i would have to see if I qualify for this new program. I then gave them all my information only to be told that I don't qualify. 

The the our President, Oboma introduced a new loan Modification program and I was to see if I would qualify for that program. Saxon  had sent me out a packet to fill out and return to them with all documents that they needed along with the packet information that I had to sign and date every page with my loan number at the top of every page. I filled out every page, signed every page and then copied all the documents that I needed to send Saxon Mortgage.

I then sent it to them Via UPS, Fed Ex, regular mail, fax, and E-mail. I have all the receipts for all the times I have sent them things, Although with all my records of sending them documents they seem to some how loose everything so I had to resend it like 5 different times. And every time I send something to them they keep loosing it again and again and again. Finally in the later part of July 09, they got everything that they needed.

I was on a trial modification period pay plan with them and I fulfilled my agreement that I signed and dated in all the documents they they received. My trail period payment program was to be "3" Just "three" months to pay the amount agreed upon. At the end of the third payment they would have an answer for me if I'M approved and what the new payment would be, I waited until the first week in Sept.09 to call them to ask what the new payment amount is and when I needed to send it in by. Only to hear them tell me that there was still no approval as of yet. They also told me that the original Loan Modification was extended and that I had signed it , I told them I never got anything from them about any extension and I'M not going to agree to pay another payment until I have documents in front of me stating such as they claim that I signed.

All thru this month Sept.09 I have been on the phone with them everyday, each time over an hour with them explaining to every teller or rep, who answers what has been going on. As they should have all my information on the computer that is right in front of them. Every time I have called some say I'M still missing documents and some ask when I'M going to send the payment in., "The Sept. 09 Payment in, they are still saying that I need to keep paying the amount that I was paying during the 3 month trial period program.  Here it is Sept. 30, 2009, and I still as of today have no letter stating any of what they have been telling me since the first part of Sept.  Just yesterday Sept. 29, 2009 I got a UPS delivered document from Saxon, stating that I have until Sept. 30th 2009 to keep me in the loan modification program. 

As the letter states,

Dear, Steve

Several Months ago, you contacted Saxon Mortgage regarding the Federal Government's Home Affordable Modification Program, (HAMP). You have completed part of the requirements for HAMP: However, there is still important documents and/or payments missing in order to qualify you for a permanent Home Affordable Modification Agreement ("Agreement"). At the beginning of September, we sent you a letter that extended the time for you to send in the missing information and,  THAT TIME IS RUNNING OUT!

At the bottom of this letter it quotes, Saxon is committed to assisting you in any way that we can, to complete your agreement, we want to help!  

OK I just got this letter from them Sept. 29th 2009 and I have until Sept. 30th to do something about trying to stay on this program, that is Government assisted.

Also on the bottom of this letter it states,
if you fail to contact us by September 30, you will no longer be eligible for HAMP, this is a one-time-only-opportunity. Please call during the time from 7:00 AM- till 10:00 PM, Well i have tried to call them all day Sept. 29th and every time I called I waited on the phone for over 1 hour, then to only be disconnected, then I tried them at night after 5:00 Pm only to hear that they are only open from 7:00 Am till 5:00 Pm , Mon-thru sat. and please call back during normal business hours.

Man I think at times with all the stress I have been going thru with Saxon Mortgage I'M going Nuts, I'M a single person who's been trying to keep my dream of a home owner alive, But I'm not to sure how long I will be able to go on with Saxon, they don't even let you talk with a supervisor, But I finally did, but was on hold for like 2 hours. That was last week and he was very rude to me until I made him be quite and listen to what I had to say, every time he tried to run and talk over me I got louder and louder on the phone until he just was quite and let me talk. 

I really need someone to help me but I cannot afford to hire any legal counsel, does anyone have any suggestions?

In desperate need of Help.

If you haven't, you may want to do that asap....

I'm going through the exact same thing as you they even sent me the same letter on September 29 and i also had till the 30 to call back. i hate this company !! when i got a hold of them they told me they didn't know what was missing they said i quote" there's a note on your account that's something is missing but its not saying what? I'm so tired of them i just want to foreclose but i put so much money in this house it will be ridiculous to do so. Are they saying that your loan is underwriting yet ?? that's also why she told me she couldn't see what was missing!! but with my loan i think it is so crooked that i think they are scared to bring it in forward for anything.. here his my story when me and husband got this loan we lived in Florida and we got this prebuilding home in north Carolina through Cpmoran. most loan companies wont finance and pre-building home so when we fund them we were happy because the offering an 80/20 so we went with them 2 weeks before closing they told us they were missing some documents we sent them and then the change the terms of the loan!!! since we already put a lot of money down on the house for upgrades and which none of it was refundable and that if we back out of the deal cpmorgan could sue us for $7000 or more because we had a house built for our preference so we just went with the terms. they also told us they would gladly refinance us after a year of living here in north Carolina. back them my credit was 797 and now is 520 because of them. keep in mind i never owned a home before I'm 21 my husband 24 at the time. we don't have parents or nobody to help us through this. so my terms are second home mortgage (we never owned a home But since we lived in Florida they told us we had to buy it this way as a vacation home)
2 year arm and balloon rate payment !!! my interest his 9.75% on the 80 and 11.25%on the 20
only if i knew then !!! anyways we weren't able to get a refinance on the loan because the market crashed !!we try to sell at cost but no hope there and then before i knew my mortgage was going up i kept trying to call and beg for help but they say they couldn't help me so when time came i just decided i'll stop making payments and maybe they will listen and its not that i cant afford them i just hate them!!!!12$ goes towards principal and my last payment on the balloon rate is 160,000$ on a 169,000$ on a 30 year mortgage. its insane I'm better of foreclosing  so for 8 months i didn't make payments from October to may and they never even called me or even sent me notices, i just kept getting statements and that's it. it could of probably went on longer but i called them saying !!hey whats up! don't you guys want my money??? and then they sent me foreclosure notice and everything and then i got a letter from hamp and so for June July and august i made the trial payments and forward all documents and then they told me i was missing documents so they extended for two more months because i made all my payments on time and this is where I'm now. anyone got any advice !!

Anyone fit this scenario:

1. Saxon is the entity that is foreclosing
2. Non-Judicial State
3. You have visited your county recorder and obtained:
     A. assignment from MERS to Saxon
     B. substitution of trustee
     C. assignment from Saxon to securities trustee

If so, look at the names of the "vice president's" who have signed these documents.  If you have one of the following individuals signing as VP, please contact me

Hello everyone,

Saxon Mortgage company is the worst I have ever had to deal with.  I recently wrote a letter here, and now I would like to add more info.  I was put on a trial period monthly program in which I was supposed tro have a loan modification done to my home.  I completed their 3 months trial period and then they said they sent me a new extended trial program and that I signed it, I have never recieved anything from them, and I never signed any agreement to do another 3 month trial period program.  And then I gave in and made my 1st. extended trial period program payment in Sept. actually the last few days in Sept.  So that I could stay on the loan Modification program that they said I was on already.   Now this month I called and told them I would be late, and they said ok, as long as the payment is received or paid on the 31st. of this month.  They even sent me a letter with the hours that they would be reciving payments, It clearly stated that they would be there on the 31st. and they would be open from 8:00 Am til 9:00 PM saturday.  I tried half of the day to make my payment to them and then I was told that I couldn't make the payment as this month has already passed. this was at approx. 1:00 PM Saturday afternoon. 

TI fuffilled the first 3 months that I origianlly signed for, and now, being late on the extended trial period program, to me I wasn't late, I was going to get it in by the end of the month, and the end of the month was the 31st. Well they refused to take my payment and now my house is in foreclosure. It really makes me sick thinking that they just kept me making payments on my home and telling me lies after lies, as they knew that they were never going to get me a loan modification in the first place. This company has to be stopped by someone out there, I would think that with all the complaints that someone out there knows someone in the Legal department in which we could fight this company from taking our homes.   I have been in my home for 11 years, and Now IM at the end of my rope and going into foreclosure.  I don't want to losse my home but IM out of suggestions and out of solutions of what I can do to stop them.  

I don't understand how a company out there can actually send out a package and have you sign it and then after your (3) threemonth program is over then they can say that they sent another and have your signature on the next set of papers and then make you pay another 3 months,  I NEVER SINGED ANY ADDITIONAL PAPERWORK to agree to make another extended 3 months to them.  How can the government still be sending them money to try and help homeowners when they are not helping anyone but themselves. 

Has anyone or is anyone else having the same issues with Saxon Mortgage ?  Did anyone get a loan modification after the 3 month trial period program was completed ?  did they tell you that your loan modification was extended out for an additional 3 months ?   Is anyone else going thru this ?
